Democratic control of Senate is possibly lost!
[link|http://hotair.com/archives/2006/12/13/breaking-report-sen-tim-johnson-suffers-stroke/|Senator Tim Johnson] D - SD) has reportedly suffered a stroke. His condition is unknown. Please keep his health and safety in your prayers. If the Senator does step down, or God forbid, passes away, the majority part of the Senate could change as North Dakota has a Republican Governor.

Isn't it currently 51/49
Would be gridlock time 50/50

It doesn't sound like his condition is too bad, right now.
[link|http://www.washingtonpost.com/wp-dyn/content/article/2006/12/13/AR2006121301509.html|Washington Post]: Earlier today the senator had been on a telephone call with reporters when he became disoriented and began stuttering in response to a question, the Associated Press reported. He seemed to recover, asking if there were any additional questions before ending the call. It depends on the severity of the stroke, of course, but politicians can continue to serve after a stroke. My [link|http://www.toddy.org/about|state senator] had one years ago and still has obvious weakness on her left side. (I saw her in my grocery store recently.) [link|http://en.wikipedia.org/wiki/Harry_Reid|Harry Reid] suffered one in 2005. Let's not panic yet. :-) Cheers, Scott.

Maybe, but there are converts
[link|http://www.crooksandliars.com/2006/12/11/sen-gordon-smith-speaks-out-about-iraq-i-cant-be-quiet-any-more/|http://www.crooksand...e-quiet-any-more/]
Sen. Gordon Smith, (R) Oregon said on CNN recently:
Sen. Smith: I simply hit the end of the rope if you will. I felt I had to speak up because if these sacrifices are being made in pursuit of policy that cannot succeed then we need to admit it and readjust in a way that the American people and our soldiers find worth the sacrifice and this is not.\ufffdI find examples like the British generals day after day in the first world war would send thousands of their men running into machine guns and not make adjustments. I find that criminal.
And when we send our young folks out in vehicles that cannot take out, er, er accept these kind of blasts to them without taking their lives I don;t find that smart. I find that derelict in duty\ufffd
Blitzer: Who should be held accountable\ufffdI'll just use a word "fiasco" or disaster or some word along those lines?
Sen. Smith: Well, I think all of us with positions of responsibility are accountable. but clearly I can't be quiet any more.

I think it's not a state issue.
Once elected, a congressperson's "fitness to serve" is at the discretion of the house s/he serves in. No where in the constitution (as far as I can tell) does it say a Governor may expel a member. Only the congress/senate has that power. Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller Number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.
Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member.
(emphasis added) [link|http://www.archives.gov/national-archives-experience/charters/constitution_transcript.html|here] is a copy of the constitution. Now with hyperlink goodness!

ya missed something
I was talking about the replacement process, not the removal process whether the state guv has an autrocratic choice or has limitations on the replacement. thanx, bill

Out of surgery; Critical condition; Still no specifics.
It's sounding very mysterious though. [link|http://www.washingtonpost.com/wp-dyn/content/article/2006/12/14/AR2006121400379.html|Washington Post]: Nursing supervisor Quinn Collins said early today that the senator was out of surgery and in critical condition. Hospital officials and Johnson aides offered no further comment or details; a more complete statement was expected later this morning. I guess we'll have to be patient. Cheers, Scott. (Hi Bill. ;-)
