The courts have determined a lot of things.
If you accept the courts as the final arbiter of what the Constitution means, I presume you accept the Dred Scott decision as the acme of constitutionality.

Oh, and while we're on the subject...
let's have no more whining about Al Gore not being in the White House. It was the Supreme Court who broke that tie. Which, by your standard, makes it all Constitutional and altogether enlightened and righteous.
Me, I just call it damn lucky. I'd hate to have had Gore in charge when the planes hit.

I did not vote for Bush or Gore, so I never whined about
the way the issue was settled. Neither was qualified. The two party system failed us all.
Bush is president. Hopefully, only for a single term.

But the fact I'm waiting and seeing says something about Bush as president.
Dammit, why can't either party put up a decent candidate? Bob Dole, Bill Clinton, Al Gore - *none* of them are worth a bucket of snot. Bill Bradley, despite being a Democrat, I could have voted for. There are other decent Democrats and Republicans I coulda voted for... but Bush vs. Gore? Ye willikers what a sad-ass choice.

Indeed: you and all the other loyal patriots
would have been howling "wag the dog" every time a soldier landed in Afganistan.
But at his point, it might be nice to have someone in there who can understand why the kings and despots he needs as allies - or at least as neutrals - might not be enthusiastic about his vision of bringing democracy to the region.

That's how our justice system works. :)
The Dred Scott decision was corrected.
It's pretty clear to me that the framers of the Constitution did not want to have another "Church of England", but, within reason, to allow religious freedom. It's a fundamental principle.
