Burping just before a test can increase BAC*. Having a drink just before can bump it. Faulty parts in the device, operator error. Lots of ways to screw up a breathalyzer.

It should be somewhere in the neighborhood. In Ohio, I think they are recognized as being possibly inexact, but they are awful hard to challange. I gather that the cops are required to make multiple types of sobriety tests. Probably nothing to do with justice; there's a lot of money riding on a DUI that they don't want to get away.

They put them in downtown Cleveland a couple of months ago. A recent newspaper article quoted several people from the city administration and the police department talking about what a great job they were doing, and how they had met or exceeded all expectations.

I only wish one of them had described a benefit that didn't have a dollar sign attached.

They are trying to run the police department as a profit center. A lot of the suburbs are running their police the same way. It's the difference between a bankrupt society and a free one. That can be taken a number of different ways, all[1] pretty much accurate.

[1] Now somebody's going to come up with a way I didn't think of in rebuttal, but in general...

I've admitted a few people to detox who were walking and talking with a BAL of .6, but the average is usually .35. It's all about tolerance.

In college I was pulled over by the police and blew a .1, which at the time was the legal limit. The cop made me drive into a parking lot and sober up. Which was a good thing, because I was stumbling drunk, and had no business behind the wheel of a car.
