New What kind of landlord?
With corporate-owned apartments, I've never had a problem. Several times I've got the entire deposit back.

OTOH, a friend who was renting a privately owned house just about had to go to small claims court to get his deposit (or the appropriate part of his deposit) back.

New Both kinds.
We've moved from 5 places in the last decade. 2 institutions, 3 private homes. I know that we got refunds at all 3 private homes, and at least one institution. I am not sure about the other institution, but if we didn't get a refund it would only be because we did not have a damage deposit.

The one that was most difficult to get a refund from was the crap apartment building that we suspected was being run by people with mob ties. (Our first home in NYC. It was convenient to midtown and it was cheap for NYC. I can say nothing else good about it.)

The less you can afford it, the more likely they'll keep it. Or more accurately, the more sure they are you can't afford the lawyer.
