New doesnt work like that over here
have a 2k deposit. Owe partial last months rent 1050 leaving $950 for repairs and carpet cleaning. He decided to replace the capets and dun me for a portion of the bill of 2100 claiming that 4yo carpets had 3 years of life left and I ruined them. 1800 for repaint of which he is dunning me a 3rd miscellanious breakage (valid $460.00) he wants the balance of 1499.00 paid promptly or he will report me to the credit bureau. I dont disagree with the pricipal but I dont want to pay for a remodelling after I leave either. He can sue me in small claims court for the 1499 or leave it on my credit report forever, ask me if I care, I already got the house so fuck him. He is/was a reasonable person so I will pay what I feel I owe and negotiate on the balance. My tenants left with my appliances. Didnt work up too much of a sweat.

No matter what the security deposit is, there will be more claimed damage than that. As someone said, a repaint is SOP regardless of condition. I've been burned by the carpet trick, too. Unless you have a signed inspection before you leave, it's your word against the carpet cleaner's. And he's on retainer to the landlord. What do you think he'll say?

My wife and I have never had our full security deposit taken. Coincidentally (?) we've always been on good terms with our landlords.

Oh, some gets taken out. Generally for pretty reasonable things. But never the whole thing.

New What kind of landlord?
With corporate-owned apartments, I've never had a problem. Several times I've got the entire deposit back.

OTOH, a friend who was renting a privately owned house just about had to go to small claims court to get his deposit (or the appropriate part of his deposit) back.

New Both kinds.
We've moved from 5 places in the last decade. 2 institutions, 3 private homes. I know that we got refunds at all 3 private homes, and at least one institution. I am not sure about the other institution, but if we didn't get a refund it would only be because we did not have a damage deposit.

The one that was most difficult to get a refund from was the crap apartment building that we suspected was being run by people with mob ties. (Our first home in NYC. It was convenient to midtown and it was cheap for NYC. I can say nothing else good about it.)

The less you can afford it, the more likely they'll keep it. Or more accurately, the more sure they are you can't afford the lawyer.

New Well, speaking as a landlord
Renters do wacky things sometimes, then refuse to own up. How much money I keep is directly proportional to how much work/annoyance I have to do/put up with to make the place look like it was when you moved in.

Example, last renter ran speaker wires using some kind of sticky tape along the baseboards that left lots of glue residue on the wood floors. It took me experimenting with 3-4 solvents and a lot of elbow grease to get that stuff off. Thus, I dinged him big for it.

You can't generally hire decent janitorial help that gives a damn and have to do it yourself. Giving a damn costs my time so you get to pay my consulting rates when you do stupid stuff that I have to fix myself.

He could have gotten his money back by cleaning that stuff up himself.

I've only kept a whole deposit once (and I get a big deposit) and that was for a psycho I evicted after only two months. It cost pretty much all of it to fix the place up, plus lost revenue for having down time, lawyer fees, asshole tax, etc...
