probate judge does not confer guardianship, he ruled in error. Common sense dictates that georgia laws must be followed.

Ms. Gaddy doesn't have any say in Mae's condition.

Mae has a Living Will to state what she would want when she wants it.

Google only lists about 9 articles on this, in my searches, and almost all take the position that the grandaughter is evil and the judge was wrong. Why is that?

I can't find anything about Probate Judge Donald Boyd's orders on the web. The closest I've found that gives his side is [link|http://www.11alive.com/news/news_article.aspx?storyid=61478|here]:

Mullinax and Magouirk\ufffds granddaughter, Beth Gaddy, fought in court over who should be her guardian.

Probate Judge Donald Boyd appointed Gaddy.

Mullinax says Gaddy has withheld nourishment and fought further treatment saying Magouirk needed to be with Jesus. He also charged that the judge went along though Magouirk was hardly comatose.

A LaGrange probate judge on Monday ordered three doctors, including one UAB cardiologist, to decide her future. They decided late Friday that the heart condition was treatable and had her airlifted Saturday morning, Mullinax said.

Mullinax said he is thrilled that his aunt is at UAB receiving care.

"Hospice is only for the dying, and my aunt has many more years to live," he said. "A crime was being committed by having a person in a hospice who was not terminally ill. I hope that this never ever happens again."

Grandson Michael Shane Magouirk, contacted in LaGrange Saturday night, declined to comment.

What I'm asking is, who's trying to publicise it, and why? After all, a lot of people are going "see, see, this is the slippery slope started by Schiavo", when what's really going on is (perhaps) incompetent administration not bothering to check bona fides before taking action... I think the real danger is the situation where the hospital (or other health institution) can use someone like the granddaughter as an excuse to cut costs without having to cut billing, leading to less than due diligence on their spadework on the actual power to make decisions.

To wit: you can't accuse the judgement in the Schiavo case to cover a situation where someone is lying about PoA etc and the doctor and institution don't bother doing even the most rudimentary followup to find out if this is in fact the case.

So, who is trying to publicise this, and why?
