Those two things are not related. You could sue me because I'm here saying Marlowe is a Moron of the Finest Water, but it doesn't mean you'd win.
Kinsella can try to sue if he wants, but if he listens to his lawyer, he won't, because he has equal opportunity to rebut their arguments and put forward his opinion. All he'll be accomplishing is enriching his lawyer and making himself look a fool, not that he hasn't done so already.
