I know that, legally, the EULA indemnifies M$ from any and all liability. But it would be nice to see the scum squirm. I can see the press conference:
Responsible (don't laugh) journalist: "Mr Gates, FirstEnergy's evidence clearly shows that M$ software is solely responsible for what is being called the worst blackout in mankind's history, causing the loss of billions to the economy and endangering the lives of millions of people. Experts are saying that if M$ would have spent a fraction of your billion-dollar hoard, this could easily have been prevented. Some are even saying that using any other company's software (all of it better and cheaper), would also have prevented this. Do you have any comment?"
Bill Gates, the Great Satan of Software: "If you read the EULA, you'll see that it is clearly not our fault. Our software is not guaranteed to do anything at all, and there's not a thing anyone can do about it. By the way, did you receive my billion-dollar donation that created the Press-M$ Frienship Club this morning?"
Now-back-to-normal journalist: "Thank you, Mr. Gates. This outage was obviously caused by communist, open software-using, hacker terrorists."
Oh well, the press conference started out good, but that part ends up on the cutting room floor.
