The U.S. government should abolish its sanctioning of marriage, argued Cass Sunstein, President Obama's regulatory czar.

Sunstein proposed that the concept of marriage should become privatized, with the state only granting civil union contracts to couples wishing to enter into an agreement.

Sunstein explained marriage licensing is unnecessary, pointing out people stay committed to organizations like country clubs and homeowner associations without any government interference.

"Under our proposal, the word marriage would no longer appear in any laws, and marriage licenses would no longer be offered or recognized by any level of government," wrote Sunstein and co-author Richard Thaler in their 2008 book, "Nudge: Improving decisions about health, wealth and happiness."

if it drives it lower and more local..and/or keeps it in church...I don't know if they'll have a huge reaction..definitely not as big a reaction as you get when trying to redefine what marriage is.

I think it is inevitable in the long run.

The courts haven't been legalizing gay marriage because judges like teh gay. They have been doing it because regulating sexual relationships between consenting adults is just not an acceptable thing for a government to do. And what's left is a domestic partnership, a kind of tiny corporation, with contractual and other impacts that are within the government's legitimate scope.

Marriage is a social and sometimes religious thing. A marriage also establishes a domestic partnership, which is a legal thing.

The changes should come from the legislative branch. But they won't. The administrative might, possibly, take care of it. But it will probably fall to the courts, again.
