In dissent, Judge Evans wrote that the Indiana law imposed an unconstitutional burden on some eligible voters. \ufffdLet\ufffds not beat around the bush,\ufffd he wrote. \ufffdThe Indiana voter photo ID law is a not-too-thinly-veiled attempt to discourage election-day turnout by certain folks believed to skew Democratic.\ufffd

Arguments that the law\ufffds purpose is to stamp out voter fraud amount to a mere \ufffdfig leaf of respectability,\ufffd Judge Evans wrote. Furthermore, he said, the law is too extreme in view of the fact that no one in Indiana has ever been prosecuted for voter fraud. \ufffdIs it wise to use a sledgehammer to hit either a real or imaginary fly on a glass coffee table?\ufffd he asked rhetorically. \ufffdI think not.\ufffd


I was half expecting the court to pass on taking this case. I think we will learn a lot what the court thinks of the current Republican leaders by how they rule on this case.
