Attorney General Alberto Gonzales' liaison with the White House will refuse to answer questions at upcoming Senate hearings about the firings of eight U.S. attorneys, citing her Fifth Amendment protection against self-incrimination, her lawyer said Monday.

"The public record is clear that certain members of the Senate Judiciary Committee have already reached conclusions about the matter under investigation and the veracity of the testimony provided by the Justice Department to date," said Goodling's lawyer John Dowd in the letter to committee chairman, Sen. Patrick Leahy, D-Vermont.

Goodling seems to be offering a very strange rational for taking the 5th. She seems to be saying that the committee has already decided that somebody is guilty and is on a witch hunt looking for somebody to nail and she won't provide them with testimony that might be used against her later.

I don't know if legally that is a valid application of the 5th, but it seems very dubious. If that where legally accepted the 5th would be used a lot more.

New If they give her immunity, she has no choice.
Sometimes immunity is used as a cudgel to get people to talk when they don't want to under any circumstances. IOW, if they give her immunity, she has to testify.

(I think we're saying the same thing, it's just that I think your phrasing was ambiguous. :-)

Monica Goodling does have a good faith basis for pleading the Fifth Amendment - just not the ones in her lawyer's letter that are getting all the attention.

Under the federal False Statements statute, 18 USC 1001, it is a felony to cause another person to make a false statement to Congress. Since McNulty has allegedly told Senator Schumer that he made a false statement to Congress based on information provided to him by Monica Goodling, Goodling could very well be prosecuted for a Section 1001 violation.

All the rest of the crap in her lawyer's letter is intended to sooth as much as possible WH anger at her for invoking the Fifth.

look at how they got Scooter. Ask him on a dozen occassions >his< version. Compare the dozen for changes in wording...and convict for perjury cause your story changed.

She KNOWS she's about to be hung out to dry by her boss.
He already told Schumer it was her fault.
So no matter what, she's screwed.
She's probably not high enough in the chain to warrant being a GW buddy, which means no pardon for her on his way out the door.
So she has to cut a deal.
And the only way she can be sure of total immunity is to clam up right now, and hope there is not enough circumstantial evidence to take her out anyway.
And they want to work up the chain, so if she's the link, she's golden.

it's likely she was told to say "X"....which means even more people can get convicted. :-)

Seeing as how taking the fifth is all about not being forced to testify against yourself in a crime. And she is accused of committing a crime... er wait. You appear to be saying she is using this as a way to keep from being forced to perjure herself. I thought telling the truth was the only protection you needed for that. How silly of me.

Interestingly enough, she does appear to have a valid case for pleading the fifth. It's just not anything remotely related to your "reasoning". I sincerely doubt any MSM outlet will cover this so I'll just say, causing someone to give false evidence. That's a crime. See McNulty's testimony.

Taking the 5th is the exact path to take, regardless of whether you feel you have committed a crime or not.
