No, I don't think so.
So, Nagin - a mayor largely disregarded by the Fed until disaster struck, a disaster that was ill-handled by Municipal, State, AND Federal authorities - FORCED Congress to grant the President the power to suspend the Constitution at any time, for any reason, as he sees fit, without oversight? In the same bill granting him the right to have people tortured? (the same tortures we howled about North Vietnam doing, as a reminder)
No - though that will certainly be used as the excuse, and as a talking point by the right-wing dominated media.
Sure. Blame everybody but the people actually doing the job of gutting the Constitution and removing any protections people have from the Government.

We have years to go.
Bush doesn't need approval from anybody to suspend the Constitution. There is no time limit, there is no limit in scope. Mid-term elections don't affect this.

To me it sounds like
preparation for dealing with the people taking to the streets in places like Ohio when they learn they've been maneuvered out of their votes by bogus purges.
IOW, it is to squash the coming rebellion that will likely arise in response to election rigging.

Lemme get this straight: the President, consistent with both previously exhibited form and substance (you do remember his "dictator" statement, don't you), under his favorite shroud of secrecy, signs a bill that effectively repeals the Posse Comitatus act, and this is Nagin's fault?!?

Seesm to me, though, that the "howls" were for troops to provide logistical support to evacuate the hell-hole that the Superdome had become, and to get food, water, clothing and medical supplies into downtown. I don't recall that he was calling for them to take over law enforcement, nor was he calling for a declaration of martial law in the area.
In fact, through my swiss-cheesey brain, I seem to recall that it was he that raised the posse comitatus argument, that troops couldn't take over law enforcement activity in "his" city.

Wrong.
You may want to look at the news coverage again.
Nagin was asking about the response and bitching about it a day before governor even signed the order for 40k guard to come in to "restore order and stem lawlessness". This was based on issues regarding the FEMA evacs being suspended in some areas because the choppers were being shot at.
You seem hell bent on re-fighting this battle based on a post that simply states the change in the law will be blamed on Katrina and the criticism of the federal government's response.

your article says so. Your "you're wrong" is directed at a specific case that I mentioned but ignores the larger issue.
So, for your sake, I accept your correctness about the specific instance of helicopters. I was incorrect.
It doesn't change the fact that there was bitching going on about troops being needed to restore order before the process that allowed them there had been carried out...and that those complaints persisted well after the event itself as one of the primary aspects of the "slow federal government response".

Where's the federal gov't response? Where are the troops to help restore order?
AND I TOLD YOU THEN that there were RULES that needed to be followed and that the rules on local, then state THEN federal were good rules.
But no, the complaints stayed. It was all Bush's fault. The feds should have just ignored all those rules and landed.
This gives the all to convenient excuse for this administration to make this change. Its that excuse I'm telling you that you will hear when this ruling is challenged.
