Wilcox says the states didn't oppose it. (It isn't clear to me whether he means the states who oppose the agreement didn't object, or whether the states who signed on for the agreement didn't object.)
I would think that if it were something which would potentially sway the trial, the states would have objected.
But who knows...

It'll be interesting to see how things play out.
