What is in foo.out?

cat /var/run/foo.out | awk '{print $4}'| xargs -t ls -l "$TIER1/$1"

And what do you expect to be in $1?

it doesnt matter what I expect to see in $1

since xargs APPENDS STDIN as an ARGUMENT to the command requested to be run :-) hence the space. Hey long day on a friday
