An act of cowardice, and yet...
So WVa can't be bothered (or, more accurately, hasn't got the stones) to join the original 19, but now that Micros~1 has been found guilty by a Fed. court, they suddenly get up enough backbone to pile on....
Nonetheless, better late than never, I guess. Who knows, this may be the way we finally tame the beast..by getting nibbled away to nothing by guppies. Maybe if Micros~1 has many resources tied up fighting a multi-front war, they might finally be brought to submission.
(Don't misunderstand, I really am happy this happened. I just had a bad day...

...no need to pony up the bucks for the big case...now that the others have paid to ensure the verdict.

I don't follow West Virginia politics, but after a quick search it seems that they have a new [link|http://www.wvsos.com/common/biography.htm|Secretary of State] this year. It is not implausible that whoever said, "We are going to sue" would have joined the original case if they had been in power back then.

Microsoft's worst nightmare
There were 19 states in the original lawsuit. There's 36 which haven't staked their claim. FoF is in effect, and if outrage over the DoJ's capitulation rises, the to-date silent states can step up to the plate, one by one. Each gets to look at the settlements offered the 9 spineless wonders, and can make a guess at how much they can wing for. Microsoft either pays appeasement, or finds itself up against the odd principled politico. Either way, this could be expensive. Or fatal.
I'd pay particular interest to states in which IBM has significant influence. They were burned in New York. I expect to see a vengence move.

Even more . .
Acording to today's Los Angeles Times, West Virginia was one of a minority of holdout states that still wanted to demand a breakup.
Industry people who have seen the States' proposal say it is of remakably good quality and strongly addresses many of the issues glossed over in the DoJ deal. Hopefully, judge C.K-K will hold the same opinion.
Microsoft has responded that the States' proposal "Undermines the agreement with the Department of Justice". In other words, they're threatening to call of the deal and fight in court if the States' proposal becomes a factor.

Why expect them to behave any smarter?
Expect to see them 'insist on their Right to a trial'. IF.. the states don't turn coward.
Maybe I can make a few bucks (with our Panhandler friend) scalpin tickets to that exhibition. What would You pay.. to see Billy Live: a rockin back & forth in full autistic mode, gettin ready to whinge..? [bring camera - sell that photo too!]

As long as you print a disclaimer that the 'ticket' is for available seating, and that seating can be denied for any reason, is subject to 'first come, first served', and disclaims resposibility for being unable to get a seat...
