The U.S. such not resort to such measures unless a declaration of war is issued by Congress. Even then, we should at least allow attorneys into the tribunal. I sympathize with the position the gov. is in when it has good reason to believe that someone is going to commit a terrorist act but has not yet done so. If they can convince a military tribunal of the intent, then they should be able to convince the military tribunal with an indepentant lawyer to represent the client. And it should be made public, no secrecy.

But this is always going to be a gray area because there's no end to the creativity of persons intent on being naughty.
