Well, that's it.
My boss got canned a week ago Tuesday.
"Inappropriate use of company resources."
And I liked the guy, too. Damn.

Was it a sacking of convenience?
ie: Why wait six months? Or did they want to get rid of him, and decided this was a good excuse?
Two out of three people wonder where the other one is.

Nope.
The investigation was only a couple months old. The admin stumbled across evidence while he was looking at something else, then took the time to build a good case against him. I feel kind of weird about it, considering there was other stuff going on - but I probably would have sacked him for his behavior as well.

wonder why he/she did'nt use the obvious defense?
I'm in charge of IT, I wanted to know if any "Trade Secrets" were going out the door?

There's a procedure in place for monitoring others.
He didn't follow it.
That defense wasn't in his job description, either.

Not at this stage.
Although I don't agree with this model, we're taking my boss's job and turning it into a DBA position. We'll have five people directly in IT:
A domain sysadmin (main servers, e-mail, security) A Siebel sysadmin (supports siebel-specific servers) A DBA (manages actual database activity) A Siebel support specialist (Will handle all end-user support related to Siebel itself) A desktop support specialist (me - everything else workstation-related)
We'll all report directly to my boss's boss, who is insanely busy already. I think that's a recipe for an extremely disorganized and chaotic IT department.

Or...
An extremely good chance to get some pet projects going... under the radar. So that they can become tailored and nicely done and show a benefit when noticed.
Not to undermine him, but help him see the light and explain the saving/benefit for something that usually costs \\$$LICENSE_COST, whereas this costs \\$$FREE_AS_IN_FREE_BEER.
I usually start with Fringe stuff. Things that are less than optimal and out of mind right now and could be significantly improved with $OPEN_SOURCE_PROJECT and $MINIMAL_AFTER_HOURS time.

That's not under the radar
Too much open convincing and politics that needs to be done with that one. Under the radar is Samba, or a Linux box doing spam catching in front of the corporate email server, or DNS, or firewall, or (insert infrastructure here) project that is invidiable, doing good things, and THEN you show how wonderful it is.

In my position...
...that's about the best I can do right now.
I've already got a box running Ghostview+Ghostscript doing stuff that Acrobat couldn't do.
