The part that worries me about this decision is that it is based on the idea that since your ISP has to copy your mail through their server they have the right to read it.

The court seems to have the idea that this is fundamentally different then phone messages, which are a constant link. But that distinction is no longer true. The phone in many cases is just using smaller packets moving around at faster speeds.

Exactly.

It would not be difficult to lock down email with all the privacy needed for a real communications medium. But, in the so-called minds of the genii steering this bluegreen ball through this arm of the galaxy, that would incurrige terrierism.
