Of course the way it is worded, they do not have to prove that anyone has sent a file, as long as it is publically accessable, the file sharer is committing a crime. Which means people who use file sharing programs need to watch out what they share, if a copyrighted file gets in their shared directory or they don't pay attention to what they share, they will be in legal trouble.

Some people just share their whole "My Documents" directory and personal files get shared, which is a security risk if they have personal info on their documents like credit card numbers, Social Security Numbers, etc.
