but it's more likely he was just drunk or stoned out of his mind.
If any deaths resulted, then we have at least manslaughter. Maybe even premeditated murder.
Even if he was `faced, it could count as murder. He may have formed the desire to kill while still "sober" and then carried it out while drunk.
But any way you look at it, we're all better off without people who drive cars into houses of worship. If he gets death, I won't shed tears for him. If he gets life imprisonment, I'll be fine with that. But if he ever gets set loose again, I'm gonna have a problem with that.
