"America Online has quietly secured a patent that could potentially shake up the competitive landscape for instant messaging software. The patent, filed in September this year, grants AOL instant messaging subsidiary ICQ rights as the inventor of the popular IM Internet application. The patent covers anything resembling a network that allows multiple users to see when other users are present and then to communicate with them."

Uh...what about IRC? Was around long before ICQ. And UNIX for that matter...could finger user (see if they're online) and talk user (chat) long, long ago.

Facts like these are hardly relevant when talking about the USPTO!

New even existed in the days of BBSes
I used to call a chat BBS - a single BBS with multiple modems that allowed you to see who was online and send messages to other users.

The sysops could even use one modem to dial into a 2nd chat BBS, and users of both systems could chat with each other. The 2nd BBS could dial into a 3rd, and so on. We'd participate in nation-wide chats about once a month. Definitely sounds networked to me.

New Heh...How about this irony...
With the patent, AOL could technically sue rival instant messaging services for infringement backed by the argument spelled out in the patent.

...And all of a sudden you've got Microsoft using UNIX-based tools to defend itself against a patent-infringement lawsuit.

Don't say that too loud...someone might be listening!

New What about Novell and message?
That was around from v2.0 days. LONG time ago. What 1990?

New As the commercial goes...
True. True.

Actually, I believe it was available before that, as it was used for long ditance comm over an existing link for the 13 machines in the pre-arpanet days.

New Had it on IBM CP/67-CMS back in late 60's too.
The predecessor of VM/CMS. Used originally between users on the same system and later between users on other networked systems.

New can they be sued for infringement of public domaine software
if programs like talk(i would have to research but I think that is a berkely product) do precisely what they claim IM does in a similar fashion. After all any IP network product must do a bind and listen session(in most cases) on an IP port. thanx,

You think that you can trust the government to look after your rights? ask an Indian
New Probably not.
What they added, I am guessing, is a database of userIds with an association of other userIds that are potentially interested in communicating with this user. When you start you Instant messenger program (however that's done) they notify all other Instant messenger programs of users that are interested in you and at the same time let you know of all the users you are interested in and happen to be On (i.e. have their Instant messenger program running) at the time. The database with userId status is maintained in real time. This is different from you seeing who is logged in and then sending them a message. The actual mechanism of sending of the message is probably (I don't know!) not part of the patent.

New talk does that using /etc/passwd
more primitive of course but prior art I would think. Cant check for sure as to see if it would try to connect to a non existant user means going offline and dumping the firewall and Im lazy:-)

New That is still not new
The chess servers have been doing something similar to that (automatic notification of when people you are interested in show up) at least since the mid-90's.

I highly doubt that it was original even then.

Ben
