Don't think so.
Its not even a constitutional issue. It'll probably never even be mentioned at the USSC level.
Its a legal decision that needs to be made. Does DMCA trump Fair Use.
If DMCA wins then there is no such thing as fair use...and we all get to throw away vcrs, cassettes, cdrs and all other copy media.
Somehow I think this is unlikely.

Well, it does say that...
but I still fail to see any constitutional issue at stake here.
It is a fair use challenge to the DMCA. One of many many to come...as the article makes clear...there are no fair use provisions...and hopefully this case will get one added.

..most certainly does not grant us a Right to Fair Use. Fair use is granted by statute...and is being usurped by greed. My point was in response to your post that "Dub's DOJ has nothing to do with this", which was shown to be incorrect.
Yet another issue on which we (sorta) agree.

I think what you'll see...
...is them step out again...based upon what we've agreed on...its not a constitutional issue...and the Judge will find that...UNLESS...these guys have stated as an intention to have the entire DMCA overturned...or the Judge thinks the result of a ruling may have that effect...(the latter...I think...being a good sign for our side)
