Don't think so.
Its not even a constitutional issue. It'll probably never even be mentioned at the USSC level.
Its a legal decision that needs to be made. Does DMCA trump Fair Use.
If DMCA wins then there is no such thing as fair use...and we all get to throw away vcrs, cassettes, cdrs and all other copy media.
Somehow I think this is unlikely.

Duh's DOJ does have something to do with itFrom the link: In addition, Susan Illston, the federal judge assigned to the case, has granted the U.S. Department of Justice's motion to intervene because the suit challenges the constitutionality of a federal law, the DMCA. [emphasis added] That is Duh's DOJ, now isn't it.

but I still fail to see any constitutional issue at stake here.
It is a fair use challenge to the DMCA. One of many many to come...as the article makes clear...there are no fair use provisions...and hopefully this case will get one added.

Yes, our Constitution (may it rest in peace)...
..most certainly does not grant us a Right to Fair Use. Fair use is granted by statute...and is being usurped by greed. My point was in response to your post that "Dub's DOJ has nothing to do with this", which was shown to be incorrect.
Yet another issue on which we (sorta) agree.
Must be getting close to Christmas?

I think what you'll see...
...is them step out again...based upon what we've agreed on...its not a constitutional issue...and the Judge will find that...UNLESS...these guys have stated as an intention to have the entire DMCA overturned...or the Judge thinks the result of a ruling may have that effect...(the latter...I think...being a good sign for our side)

Given the Skylarov verdict, they may have a chance, now!
But copyright law expert Evan R. Cox, a partner in the law firm Covington & Burling, noted the DMCA as written does not provide an exemption for fair use.
He also said previous court challenges to the DMCA have been mostly unsuccessful.
However, Cox said the movie studios also have to deal with sentiments that go far beyond any courtroom, "a sense of justice on the part of customers" who already feel entitled to make backup copies. [emphasis added] Interesting that this is the same guy that said, [link|http://news.com.com/2100-1023-978176.html|in relation to the Skylarov decision]: "It is troubling for enforcement of the (criminal provisions of the) DMCA," said Evan Cox, an attorney with the San Francisco firm of Covington & Burlington. "This was the kind of case that the DMCA was meant to prevent. If this enforcement led to a not guilty verdict, you have to wonder what would lead to a successful case." His hemming-and-hawing means one of two things: either things are now moving so fast in this arena that no one can kkep up, or this guy will say whatever his client-du-jour pays his fees to say. Nonetheless, the timing of this suit could not have been better for 321's purposes. I wish them good luck (and better lawyers!).
