Executive summary: Odds are that the case will be decided by the written briefs. The court clearly understands his argument, and their main concern is about whether they truly have authority to make the decision that he wants them to make.

He describes this as "...resisting the right thing for the right reasons..." and thinks that it is good. I am inclined to agree.

He seems cautiously optimistic but worried as hell.
