I liked this quote from the article: "If published research does not include working code, the odds of a successful lawsuit rapidly approach zero." Of course, that means that one can't publish research that actually has proofs that the subject works.

I'm with the academics on this one... and let's not forget that they have the object lesson of Skylarov (Sklyarov?) to see.
