A Louisiana man was sentenced to more than four years in prison for bilking friends and family out of more than 800- thousand dollars by convincing them his wife was a government agent.
He claimed she could arrange to have their medical problems diagnosed by satellite imaging.

.1% of 10 Million SPAM sent == 10,000 orders

10,000 orders of Viagra @ $40/order == $400,000 per day

$400,000 per day / 365 days per year == $146,000,000/year

OK, reduce it to .1% of 1 million spam per day still == $14,600,000 per year

even if 20% profit margin, $2,920,000, heck... 10% margin == $1,460,000

SPAM is here to stay until SOMEONE (read: the unwashed masses) stops responding to SPAM and rewarding it.

Economy of scale beats public opinion every time.

So, you tell me... those fines will NEVER happen in any case, there are too many levels (and probably countries) between the "spammer/seller" and the manufacturer.
