Since September 2003 big music labels have pressed their case with lawsuits by the thousands. Back then the industry said it was hoping to scare off an estimated 4 million music-sharing fans. Today that number has more than doubled to around 9 million people using file-trading sites. The industry insists its lawyers are keeping a lid on what it calls songlifting.

Make it good and price it fairly.

One look at the success of the iTunes store will tell you there IS a market music and its willing to pay...to a point. Past that point...they're willing to risk that call from the RIAA.

Sadly, she broked. One drop and boot across a machine-room floor too many, I wot.

Disk failure, sad iPod on the screen. It's in bits now, awaiting a new disk that may never come - because I've ordered a 16GB iPod touch.

The lack of moving parts is a definite plus for me.

New Free? Illegal? ... What's the difference?

The industry might actually be tempting youngsters, and even adult fans, to try out the very file-sharing sites it's battled for years to shut down.

You can hear this confusion as the head of the RIAA lays out his case for us. Initially, he argues flatly that "free" means "illegal."

BAINWOL: The reality is, almost everybody understands that the practice of taking copyrighted works for free is illegal.


But what about when the industry is giving away its own free songs? . . . This summer, a deal was announced to flood file-sharing sites with 16 million free downloads, reportedly from the popular rapper Plies.

Trouble is, fans were left guessing exactly which track would be legally free. And until the file is actually downloaded, there's no way to be sure that it's the "authorized" version that includes an embedded ad. Sprint pays for its logo to appear whenever the song is played.

We tried asking the industry's top representative how the average law-abiding teenager -- or even his own organization -- might tell the difference between what's legal and what's not. But even Mitch Bainwol didn't seem to know clearly:

BAINWOL: There are tools, in terms of, uh, uh, authentication here, and, uh, uh, I'm not a technician so I'm, I'm, I really can't go into that in great detail. I'd be happy to get you somebody who can.


Check the press release announcing those free ad-supported downloads we mentioned and it simply says, "The tracks are indistinguishable from illegal, pirated content."

New Music biz's future rests on key changes

Von Lohmann [of the EFF] has little sympathy for an industry that's been complaining about free downloading for almost a decade now:

Von Lohmann: Get out there and do the work, right? Bottled water competes with free every day, private schools compete with free every day, lots of industries compete with free by delivering a better product, a more convenient product.


He says the attraction of file-sharing sites isn't just that they're free -- they offer a far better selection than any pay site, he says, with no restrictions on how files can be copied or played.

Von Lohmann: You've got to give fans what they want. They want the whole catalog, they want it conveniently and, you know, I think they'd be willing to pay a few dollars for it. But oftentimes, you can't really get all the songs -- even on iTunes, even if you want to pay for them.
