New Microsoft patented the ipod

Although Apple introduced the iPod in 2001, it did not file a provisional patent application until July 2002. Microsoft filed a patent in May of 2002, which included key elements of the popular music player, including the menu software. According to AppleInsider.com, Apple could be forced to pay Microsoft up to $10 per iPod.
why invent anything if you can just steal it.

New Appleinsider is daft, then.
If Apple introduced the iPod in 2001, and MS filed in 2003, then Apple is holding the prior art.

Congress is trying to "rectify" our patent law to match European law where the first to file gets the patent no matter how long ago someone else invented it. Prior art is irrelevant.
