Possibly no cowardice involved

I don't follow West Virginia politics, but after a quick search it seems that they have a new [link|http://www.wvsos.com/common/biography.htm|Secretary of State] this year. It is not implausible that whoever said, "We are going to sue" would have joined the original case if they had been in power back then.
