There are tremendous ramifications if this logic gets extended to the final decision and if it's upheld on appeal.

Gee, software might actually be like a book or something.... It's insane, IMO, that ubiquitous PC software has such restrictive terms (terms which might make sense in cases where the market is a few dozen seats worldwide).

What the DoJ giveth away, will Judge Pregerson take back? :-)
