Not Vaporware, but this $4000USD "Phantom" game console is basically a PC running Windows XP and an encrypted file system with no floppy, CD-ROM, or other drives besides a hard drive. The games get downloaded from an ISP Broadband connection and has electonic payments. Opening up the "Phantom" voids the warranty and violates the End User's License.

Frankly I don't see the appeal of a $400USD console when for a little more you can get a real deal PC with XP or Linux on it. Or for less you can get a PSX2, Gamecube, or XBox that already has a ton of games available for them.

I imagine this will be a subscription service and for a monthly fee you can have Trial Games to see if they are any good and download them from the Broadband ISP after buying them. It might just help 3rd party developers who want to get their names known and cannot afford to press CD/DVD ROMS and ship them.
